WestJet fires new salvo in Air Canada legal tussle

WestJet fired another salvo in its legal war with Air Canada Wednesday, suing the larger airline and three of its current and former executives for abusing the judicial system and conspiring to destroy WestJet. The new lawsuit names Air Canada, its former subsidiary Zip Air Inc, Air Canada CE Robert Milton, former chief restructuring officer Calin Rovinescu, and Stephen Smith, a former senior VP of customer experience at Air Canada and president of ZIP from 2001 to 2004. Smith was also president of WestJet from 1999 to 2000. WestJet is seeking C$25m in damages for abuse of process, intentional interference with economic interests and conspiracy, $5m in punitive damages, and costs. 'Competition is one thing, but the use of litigation as a stalking horse to advance avenues of attack, for the purpose of eliminating a competitor, is another,' WestJet says in its statement of claim. Air Canada started a legal action against WestJet 'for no other purpose than the destruction of WestJet as a competitor.' WestJet claims that the defendants conspired to damage WestJet's reputation, destroy it as a competitor, and line their own pockets. None of the allegations has been proven in court. Air Canada said Wednesday the new lawsuit was 'without merit'.
